These Terms of Sale apply when you purchase goods from Aquassi Ltd through our website. Please read them carefully before placing an order.
By submitting an order, you agree to these Terms of Sale. Nothing in these terms affects the statutory rights available to consumers under UK law.
Aquassi Ltd supplies aquarium, aquascaping and related lifestyle products through our online store.
Our full registered company name, registered office, company number, contact information and any other legally required business information should be displayed on our website and/or order documentation.
We take reasonable care to ensure that product descriptions, specifications, photographs and other information displayed on our website are accurate.
Product images are provided to help illustrate the products available. Actual colours, packaging, dimensions or appearance may vary slightly.
Natural aquascaping products such as rocks and wood are naturally variable. Individual pieces may therefore differ in colour, shape, pattern, texture and appearance from photographs displayed online.
All products are subject to availability.
Adding a product to your basket does not reserve that product.
If a product becomes unavailable after you place an order, we will contact you and, where appropriate, offer an alternative, delay fulfilment with your agreement or provide a refund for the unavailable product.
The price payable is the price displayed and confirmed during checkout, subject to correction of obvious errors where permitted by law.
Any mandatory charges applicable to the purchase will be presented clearly as required before you complete your order.
Delivery charges, where applicable, will be shown before the order is submitted.
Promotional prices may only apply during the stated promotional period and may be subject to additional promotional terms.
When you place an order, you are offering to purchase the selected goods subject to these Terms of Sale.
After submitting your order, you should receive an acknowledgement confirming that we have received it.
An acknowledgement of your order does not necessarily constitute acceptance.
The contract between you and Aquassi Ltd is formed when we expressly accept your order or dispatch the goods, according to the ordering process communicated to you.
We may refuse or cancel an order where reasonably necessary, including where:
A product is unavailable
Payment cannot be authorised
Incorrect information has been supplied
An obvious pricing or product-description error has occurred
Delivery cannot reasonably be completed
We reasonably suspect fraudulent or unlawful activity
Where we cancel an accepted order for which payment has already been taken, the appropriate refund will be issued.
Payment must be made using one of the payment methods available during checkout.
You confirm that you are authorised to use the payment method submitted with your order.
Orders may be subject to payment verification and security checks.
Following acceptance of your order, we will provide confirmation containing the relevant details of your purchase.
Please check your confirmation carefully and contact Aquassi Ltd promptly if you believe any information is incorrect.
We aim to process and dispatch orders as quickly as reasonably possible.
Estimated delivery information will be provided on our website, during checkout or within your order confirmation where applicable.
Unless a different delivery period has been agreed, goods will be delivered within the period required by applicable consumer law.
Delivery estimates may occasionally be affected by circumstances outside our reasonable control.
Customers are responsible for supplying an accurate and complete delivery address.
Aquassi Ltd will not be responsible for avoidable delays caused by materially incorrect delivery information supplied by the customer, subject to applicable consumer law.
If an order is returned because delivery could not be completed, please contact us so that the appropriate next steps can be arranged.
For consumer purchases, responsibility for accidental loss or damage will pass in accordance with applicable consumer law.
Where Aquassi Ltd arranges the carrier, consumers will generally not bear the risk of loss or damage merely because the goods have been handed to that carrier.
If you are a consumer purchasing qualifying goods online, you will normally have a legal right to change your mind and cancel the contract.
For most qualifying goods, the cancellation period ends 14 days after the day on which you, or a person nominated by you other than the carrier, receives the goods.
Different calculations can apply where one order contains multiple goods delivered on different days.
You do not need to provide a reason for exercising a statutory cancellation right.
To exercise your cancellation right, you must clearly inform Aquassi Ltd that you wish to cancel.
You can contact us using the contact details provided on our website.
You may use a statutory model cancellation form where applicable, but you are not required to use that form as long as you clearly communicate your decision to cancel.
After notifying us of a qualifying cancellation, you must return the goods without undue delay and within the period required by law.
Unless Aquassi Ltd has agreed to pay the return costs, or the law requires otherwise, you may be responsible for the direct cost of returning unwanted goods.
Please package returned products appropriately to reduce the risk of damage during transportation.
You may inspect goods in a manner similar to how you would reasonably inspect them in a physical shop.
Where handling goes beyond what is reasonably necessary to establish the nature, characteristics and functioning of the goods and causes a reduction in value, we may make an appropriate deduction from the refund where permitted by law.
Statutory cancellation rights do not apply to every type of product.
Exceptions may apply to certain:
Bespoke or personalised goods
Goods made to a customer’s specifications
Goods liable to deteriorate or expire rapidly
Sealed products where statutory hygiene or health-protection exceptions apply after unsealing
Other products specifically excluded by applicable legislation
We will not describe a product as non-returnable where doing so would unlawfully restrict your statutory rights.
Where you validly exercise a statutory right to cancel, Aquassi Ltd will provide the refund required by law.
Where applicable, this will include the price paid for the goods and the standard outbound delivery charge required to be refunded by law.
If you selected a more expensive delivery option than our least expensive standard delivery service, we are not required to refund the additional delivery cost beyond the statutory amount.
Refunds will normally be made using the original payment method unless otherwise expressly agreed.
Refunds will be processed within the applicable statutory period.
For returned goods, we may be entitled to wait until we receive the goods back or you provide evidence that they have been returned, whichever occurs first, before completing the refund.
Your statutory rights are separate from your right to change your mind.
Goods supplied by Aquassi Ltd must meet applicable legal standards, including being of satisfactory quality, fit for purpose where the relevant requirements are met, and as described.
If a product is faulty, damaged, incorrectly supplied or does not conform to the contract, please contact us.
Depending on the circumstances and applicable law, you may be entitled to remedies including:
Rejection and refund
Repair
Replacement
Price reduction
Final right to reject
Nothing in these Terms of Sale limits your statutory rights concerning faulty or non-conforming goods.
Please inspect your order after delivery where reasonably possible.
If you discover that goods have been damaged during delivery, contact Aquassi Ltd promptly with your order details.
We may request photographs of the product, packaging and delivery condition to help us investigate the problem. Providing this information does not remove any statutory rights you may have.
If you receive an incorrect product or something is missing from your order, please contact us as soon as reasonably possible.
We will investigate the issue and provide an appropriate remedy where required.
Some aquarium products require correct installation, maintenance and use.
Customers should follow product instructions, manufacturer recommendations and appropriate aquarium-care practices.
Incorrect use, unsuitable installation or unauthorised modification may affect product performance and may affect non-statutory warranties. Nothing in this provision removes rights that cannot legally be excluded.
Products such as natural rocks, stones, wood and similar hardscape materials may vary significantly between individual pieces.
Natural variations are part of the characteristics of these products and do not automatically constitute a defect.
Where a product is sold as a specifically photographed individual piece, we will aim to supply that particular item unless otherwise clearly stated.
From time to time, Aquassi Ltd may offer promotional prices, discount codes or special offers.
Additional terms may apply to individual promotions.
Unless otherwise stated:
Promotional codes have no cash value
Only one code may be used per qualifying transaction
Certain products may be excluded
Minimum-order requirements may apply
Offers may have an expiry date
Discounts cannot normally be applied retrospectively
Nothing in promotional terms affects statutory consumer rights.
Where customer reviews appear on our website, Aquassi Ltd will seek to handle them consistently with applicable UK consumer-protection requirements.
We will not knowingly create or commission fake reviews or present incentivised reviews in a misleading manner.
Some products may include a manufacturer’s warranty.
Any manufacturer’s warranty is additional to, and does not replace, statutory consumer rights.
Please retain relevant order information or proof of purchase if you need to make a warranty claim.
Aquassi Ltd does not exclude or limit liability where doing so would be unlawful.
Nothing in these Terms of Sale excludes or restricts liability for:
Death or personal injury caused by negligence
Fraud or fraudulent misrepresentation
Breach of rights that cannot legally be excluded
Any other liability that cannot lawfully be limited
We are responsible for foreseeable loss or damage caused by our breach of contract or failure to use reasonable care and skill, subject to applicable law.
If you purchase products wholly or mainly for business purposes, different legal rights may apply.
Where appropriate, separate business-to-business terms may apply to commercial orders.
Consumer-specific provisions in these Terms of Sale apply only where the purchaser legally qualifies as a consumer.
We process personal information in accordance with our Privacy Policy and applicable UK data-protection law.
Please review our Privacy Policy for further information about how personal data is collected and used.
Aquassi Ltd may update these Terms of Sale periodically to reflect changes to our business, products, website or applicable law.
The terms applying to an individual order will generally be those in force when the relevant contract is made.
These Terms of Sale and contracts formed under them are governed by applicable UK law.
If you are a consumer, you retain any mandatory rights concerning the courts or jurisdiction in which you may bring proceedings.
If you have questions about an order, delivery, cancellation, return or refund, please contact Aquassi Ltd using the contact information published on our website.
When contacting us about an existing purchase, please provide your order number where possible so we can locate your order efficiently.
These Terms of Sale are intended to work alongside, rather than replace, your statutory consumer rights.
Nothing in these terms is intended to exclude, restrict or misrepresent rights that cannot lawfully be excluded under UK consumer-protection legislation.
